Terms of Service

1. Acceptance of Terms

Welcome to Diclasso! Diclasso is operated by Nutistu OÜ (registry code 14322776). By using our website and services at diclasso.com, you agree to follow these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all of our domains: digiklass.ee, its English-language version diclasso.com, and the supporting domains liitu.ee and classo.it (join links) and lingi.ee (short links).

2. Service Description and Scope

Diclasso is a collection of web-based tools that is free to use (more storage is available with a license, see section 11) and designed for the personal use of the registered user. The primary user group is teachers in their own teaching, but the tools are equally suitable for other private or small-scale events — for example, team activities at work, the programme of a party, a club's activities, or other similar situations. Our services include:

• Interactive educational games and quizzes
• Classroom management tools
• Poll and voting creation
• File collection features
• Time management and organization tools
• Sharing and join links (liitu.ee, classo.it) and short links (lingi.ee)
• Other educational applications

3. User Account

3.1 Account Creation

To use certain features, you must sign in with a Google account, Microsoft account, or register with email and password. When creating an account:

• You confirm that you are at least 18 years old (of legal age)
• You register as a private individual (not as an institution's official platform) and you are responsible for your use
• You agree to share your profile information (name, email, profile picture)
• You are responsible for the security of your account
• When registering with email and password, you must use a strong password and verify your email address

Session participants — including minors — do not create accounts in Diclasso: they take part via a shared link or code. Using your account as an institution's official platform is not permitted without a separate written arrangement with us.

3.2 Account Usage

You are responsible for all activities associated with your account. Please notify us immediately if you suspect unauthorized access.

3.3 Entering Other Persons' Data

If you enter the data of other persons (e.g., the names of students, employees, event participants, or club members) into a list, you are responsible for ensuring that:

• you have the right to do so under the applicable rules and law;
• you have considered whether a nickname, first name, or initials would suffice instead of the full real name (data minimisation principle);
• the relevant persons (e.g., the parents of minors) have been informed, where necessary, that you are using their or their children's names in a web-based tool.

The same applies to content that participants create during a session — for example photos, audio recordings, or written answers. If the stored content contains identifiable people (especially minors), it is your responsibility to ensure that this is permitted.

3.4 Inactive Accounts

If an account has not been signed in to for 12 months, we send a notice to the account's email address. If no one signs in within 30 days of the notice, we permanently delete the account together with all the content you created — including content that is public or shared with others, and short links. Signing in is enough to keep the account.

An account created with an email address and password whose email address has not been confirmed and that has never been signed in to is deleted 30 days after registration. About a week after registration, we send a reminder with a new confirmation link to that address.

4. Acceptable Use

By using Diclasso, you agree to:

• Use the service only for lawful and educational purposes
• Not disrupt or damage the operation of the service
• Not attempt to access restricted parts of the system
• Not share illegal or inappropriate content
• Not use automated tools without permission
• Respect the privacy and rights of other users

5. User Content

5.1 Your Content

You retain ownership of all content you create or share through Diclasso (e.g., polls, game content, class data). You grant us permission to store and display this content only to the extent necessary to provide the service — we do not use your content for any other purpose.

5.2 Content Responsibility

You are responsible for all content you create, upload, or share. We do not monitor or moderate user content, but we reserve the right to remove content that violates these terms.

5.3 File Collection

When using the file collection feature:

• Files are stored in your Google Drive or Microsoft OneDrive account
• You are responsible for ensuring collected files comply with copyright and privacy requirements
• We are not responsible for the content of files submitted by third parties

5.4 Public Collection

You can publish your content (for example a crossword or word search) in the Diclasso public collection. By publishing:

• you confirm that you created the content or have the right to share it, and that it contains no personal data of students or other people;
• you allow other Diclasso users to view, copy and adapt the content within Diclasso. Copies show a reference to the original item. This is not an open licence: no permission is given to use the content outside Diclasso (for example to sell it);
• you remain the owner of the content and can unpublish it at any time. Copies made earlier stay with the people who made them.

We review content in the public collection based on reports from users. If content violates these terms, we may hide it from the collection; we will email you with the reason, and you keep the content itself. If you think the decision is wrong, you can reply to that email.

6. Intellectual Property

6.1 Our Property

Diclasso, including its design, code, logo, and trademarks, is our intellectual property. You may not copy, modify, or distribute these without our written permission.

6.2 Open Source

Some components may use open-source libraries licensed under their respective licenses.

7. Third-Party Services

Diclasso uses third-party services:

• Google: authentication, Drive (file collection and encrypted backups)
• Microsoft: authentication (Azure AD), OneDrive
• Content Delivery Networks: jsDelivr, cdnjs, Google Fonts
• Opalstack: server hosting and email delivery
• Ko-fi: voluntary donations (see §10)
• DB-IP: country detection database, which we keep on our own server (no queries are made to their service)
• MET Norway: weather data for the Class Board weather widget (requests go through our server, see privacy policy §7.10)

Use of these services is subject to their respective terms of service.

8. Privacy

The processing of your data is governed by our Privacy Policy, which is an integral part of these terms.

9. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue the service. For material changes — such as service discontinuation, removal of major features, change of ownership, or moving to a paid model — we will notify registered users by email at least 30 days in advance and, within a reasonable period, offer the ability to export your data (classes, games, polls, etc.) in JSON or another common format.

10. Donations and Support

Using Diclasso is free (see §9 regarding changes to the service); the only paid option is additional storage with a license (see §11). On our support page you may, if you wish, make a voluntary donation through the external service Ko-fi. The following applies to donations:

• a donation is a voluntary gift towards running the project — it is not a purchase of a product or service;
• donating does not grant additional features, priority support, any service level (SLA) commitment, or influence over which features we build;
• donations are non-refundable, except where the law provides otherwise;
• the payment takes place entirely within Ko-fi under their terms — we neither see nor store payment details;
• the limitation of liability in section 12 applies to donating users as well.

11. Licenses (additional storage)

Using Diclasso is free. If you need more storage than a free account provides, it is available with a license. Licenses are offered by Nutistu OÜ. You can send a quote request on the license page.

11.1 What a license provides

• A school license provides more storage for an agreed period to accounts whose verified email address is on the institution's email domain (for example school.edu, excluding subdomains), and to the addresses on a list provided by the institution.
• A personal license provides more storage to a single account.
• The storage limit applies to each account separately. A license does not unlock additional features or change any other terms.
• An email address counts as verified if the account is linked to a Google account, the address has been confirmed via a verification link, or the user has confirmed it for the license on their dashboard.

11.2 Concluding the contract and payment

A license is arranged on the basis of a quote and an invoice: the buyer sends a request, we send a quote, and the contract takes effect once the buyer accepts the quote. The license is activated no later than when the invoice is paid, or earlier by agreement. Invoices are issued by Nutistu OÜ and VAT is added to the price. Payment is made by bank transfer — we do not collect payment details.

11.3 Accounts remain personal

A school license does not make the institution an administrator of the accounts, nor does it give the institution access to anyone's account or content. Each account remains the personal account of its user (see sections 2 and 3.1), and a license does not make Nutistu OÜ the institution's data processor.

11.4 End of a license

A license is valid until the end of the agreed period, and the larger storage limit remains for 14 days after that. We notify the contact person 30 and 7 days before the end. If the license is not renewed, nothing is deleted: storage falls back to the free level, existing files remain, but no new files can be added beyond the limit.

11.5 Right of withdrawal and refunds

• If you buy a personal license as a consumer, you may withdraw from the contract within 14 days of concluding it without giving a reason, by writing to mikk@nutistu.ee. If you asked for the license to be activated before that period ended, you pay proportionally for the time used.
• If we are unable to provide the storage agreed in the license (for example if the service is discontinued), we refund the amount paid for the unused period proportionally.

12. Limitation of Liability

To the extent permitted by law:

• Diclasso and its creator are not liable for any direct, indirect, incidental, or consequential damages
• We are not responsible for data loss, system failures, or other problems arising from use of the service
• For free use, our total liability is limited to zero (a voluntary donation is not payment for the service — see §10)
• For a license, our total liability is limited to the amount paid for the license in the preceding 12 months

These limitations do not apply in cases of intent or gross negligence, or to the extent the law does not permit them (including a consumer's statutory rights).

13. Indemnification

You agree to indemnify and protect Diclasso and its creator from all claims, damages, and costs arising from:

• Violation of these terms
• Content you create or share
• Your activities while using the service

14. Changes to Terms

We may modify these terms at any time. Changes take effect upon publication on this page. Continued use of the service after changes constitutes acceptance of the new terms.

15. Termination

You may stop using Diclasso at any time. We may restrict or terminate your access if:

• You violate these terms
• You use the service illegally
• Your activities harm the service or other users
• The account was created in breach of the age requirement (section 3.1)

Inactive accounts are deleted as described in section 3.4.

16. Governing Law

These Terms of Service are governed by the laws of the Republic of Estonia. Disputes shall be resolved in Estonian courts.

17. Severability

If any provision of these terms is found to be invalid, the remaining provisions shall remain in effect.
